You and your spouse has agreed to forgo the court process and take the reins in a mutually agreed upon settlement agreement. That agreement can cover a range of marital claims which include property distribution, child custody and child support, spousal support, income tax filings, and waiver of certain inheritance rights.

A completed separation agreement does not eliminate the need to file for an absolute divorce after the one year’s separation.  It does finalize possible marital claims prior to divorce.
